The deadline for submitting the forms is 5:00 p.m. on Friday, June 12, 2020. Please complete the appropriate FY21 tuition and mandatory fee request form(s) for your institution's tier and programs. FY20 tuition and fee columns should be contain the amounts approved by the State Regents. Please also complete the narrative form documenting the impact on students' ability to pay, impact on enrollment, availability of financial aid, cost-effective measures implemented, communication to students/constituents and a detailed justification for all increases. For each mandatory fee which will be changing, the corresponding request for changes to mandatory fee form must be submitted. Board approval and with the date of the approval is required for all FY21 rates that you are submitting to the State Regents for approval. Be mindful not to add a formula to the proposed FY21 per credit hour rate on total resident tuition and total nonresident tuition (cell F7 and cell F9) which can cause discrepancy to 30 credit hour rate on total resident tuition and total nonresident tuition (cell G7 and cell G9) due to rounding generated from the formula you added to cell F7 and cell F9. FY21 guaranteed tuition rate shall not exceed 115% of the nonguaranteed tuition rate. As the rounding down rule does not apply to cell M9, any decimals above 115% (i.e., 115.01%) would require to be reduced to less than 115% (i.e. 114.9%). The same applies to compliance with peer limits. If the limit is 100% then your rate must fall under 100% (i.e. 99.9%). The FY21 peer limits can be found on the "UnderGrad&GradPeerLimits" and "Prof'l PeerLimit" tabs. Please note that the new date for the public hearing to review proposed changes to academic service fees and legislative peer limits is May 29, 2020 at 9:00 a.m. As in the past, it is possible that a tuition review hearing will be scheduled at which Presidents will present information to the State Regents concerning their tuition and fee requests. It has been suggested that the fund "490" be reinstated for this purpose. I am working to confirm that each agency, fund combination is available and has not been used for any other purposes. You should prepare for the amount of budget allotment your institution will need to request for federal stimulus fund expenditures for the remainder of this fiscal year, keeping in mind that at least 50% of the funds must be spent directly on aid to students. Please be expecting additional guidance for establishing budget allotment very soon. According to the press release colleges and universities are required to utilize the $6.28 billion made available today to provide cash grants to students for expenses related to disruptions to their educations due to the COVID-19 outbreak, including things like course materials and technology as well as food, housing, health care, and childcare. In order to access the funds, the U.S. Department of Education must receive a signed certification from the higher education institution affirming they will distribute the funds in accordance with applicable law. The college or university will then determine which students will receive the cash grants. All institutions must sign and return the Certificate of Funding and Agreement via: grants.gov (https://www.grants.gov/web/grants/applicants/registration.html), acknowledging the terms and conditions of the funding. A PDF of this certification has been included with this memo as an attachment (Attachment 2). After the Department has received the certificate, institutions may draw down their emergency assistance funds using the Department’s G5 system. Also attached is a letter from Secretary DeVos to college and university presidents regarding the distribution of these funds (Attachment 3). According to Secretary DeVos’ cover letter to college and university presidents, “the CARES Act provides institutions with significant discretion on how to award this emergency assistance to students. This means that each institution may develop its own system and process for determining how to allocate these funds, which may include distributing the funds to all students or only to students who demonstrate significant need. The following actions were taken with regard to FY2020 and FY2021: FY2020 This afternoon the State Board of Equalization declared a general revenue failure of $416.9 million for FY2020. This shortfall represents a change of 6% from the figures that were certified in February 2020. The shortfall could be covered by the use of funding in the Constitutional Reserve Fund made possible by SB 1053, SB 199, and SB617, which were passed by the Legislature on April 6, 2020. The use of "Rainy Day" funds could fully fund the original appropriations for FY2020 and avoid budget cuts for the remaining two months of the fiscal year. The Board of Equalization unanimously voted to approve the certification of the revenue shortfall for FY2020. Voting in favor of the motion were Governor Kevin Stitt, Lieutenant Governor Matt Pinnell, Attorney General Mike Hunter, State Treasurer Randy McDaniel, State Superintendent Joy Hofmeister, State Auditor & Inspector Cindy Byrd, and Oklahoma Commissioner of Agriculture Blayne Arthur. FY2021 During the Board of Equalization meeting, state officials also received a presentation on Oklahoma's financial picture for the fiscal year that begins July 1, 2020 from the Oklahoma Tax Commission. The slides from this presentation have been attached for your review. The revised revenue projections show the state would have approximately $6.9 billion for FY2021. The current year's state budget was built on a revenue projection of $8.3 billion. This represents a $1.4 billion (16.6%) reduction in the revenue available for FY2021 that was certified by the Board of Equalization at their February meeting. The Board of Equalization also voted on a motion to send a letter to the Legislature from Governor Stitt with the new estimated calculations provided by the Oklahoma Tax commission for FY2021 to consider as the total revenue available for the FY2021 budget. There is a function in Colleague that allows it to be applied through their bursar’s account but not applied to an outstanding balance. Also attached is a letter from Secretary DeVos to college and university presidents regarding the distribution of these funds (Attachment 2). According to Secretary DeVos’ cover letter to college and university presidents, Section 18004(c) of the CARES Act allows higher education institutions “to use up to one-half of the total funds received under Section 18004(a)(1) to cover any costs associated with significant changes to the delivery of instruction due to the coronavirus.” In order to access the funds for Recipient’s Institutional Costs under Sections 18004(a)(1) and 18004(c) of the CARES Act, institutions must sign the Recipient’s Funding Certification and Agreement for the Institutional Portion of the Higher Education Emergency Relief Fund (Attachment 3) and return it via grants.gov (https://www.grants.gov), acknowledging and agreeing to the terms and conditions of the funding. After the USDE has received the Certification and Agreement and verified the information therein, institutions may draw down their funds for the Recipient’s Institutional Costs using the Department’s G5 system. According the USDE website (https://www2.ed.gov/about/offices/list/ope/caresact.html), institutions must complete and submit the Certification and Agreement for the emergency student financial aid allocation of CARES Act funding before submitting the Certification and Agreement for the institution’s allocation of CARES Act funding.. Finally, please find attached the “Allocations for Section 18004(a)(1) of the CARES Act” as produced by the U.S. Department of Education for your review (Attachment 4).
