<p class="MsoNormal"><a name="body"></a>The Attorney General’s Chief of Staff, Melissa Houston, just advised me of the Attorney General’s opinion on the Master Lease Program. From Higher Education’s standpoint, the opinion appears to be favorable in every
aspect. <o:p></o:p></p>
<p class="MsoNormal"> <o:p></o:p></p>
<p class="MsoNormal">In essence, the five chief components of the opinion are: <o:p>
</o:p></p>
<p class="MsoNormal"> <o:p></o:p></p>
<p class="MsoNormal">1. The statutes authorizing the Master Lease Program are constitutional.<o:p></o:p></p>
<p class="MsoNormal"> <o:p></o:p></p>
<p class="MsoNormal">2. The Master Lease Program does not impermissibly delegate Legislative authority to the State
<o:p></o:p></p>
<p class="MsoNormal" style="text-indent:.5in">Regents.<o:p></o:p></p>
<p class="MsoNormal" style="text-indent:.5in"> <o:p></o:p></p>
<p class="MsoNormal">3. The State Regents may use the Master Lease Program to construct a building to be utilized by
<o:p></o:p></p>
<p class="MsoNormal" style="margin-left:.5in">a state agency not under the State Regents’ direction – so long as the construction of the building fits with the State Regents’ constitutionally-defined educational mission.<o:p></o:p></p>
<p class="MsoNormal" style="margin-left:.5in"> <o:p></o:p></p>
<p class="MsoNormal">4. Repayment of any bonded indebtedness created under the Master Lease Program is the
<o:p></o:p></p>
<p class="MsoNormal" style="text-indent:.5in">responsibility of whoever is designated as responsible in any particular transaction.<o:p></o:p></p>
<p class="MsoNormal"> <o:p></o:p></p>
<p class="MsoNormal">5. The Legislature has not placed a statutory dollar limit on the amount of indebtedness that can

<p class="MsoNormal" style="margin-left:.5in">be incurred by the State Regents with respect to acquiring real property through the Master Lease Program.<o:p></o:p></p>
