(Her mother recently did this to us and based on her eagerness to get her refund check and other factors that I won't bore you with, we really think this is her intention.) Of course, if she is successful, we will be left with an unpaid balance when she "runs." She is accepted into our program as a degree seeking student and was awarded financial aid. We have not disbursed any funds yet because her classes just started. She admitted recently that she intends to take 9-12 hours and then transfer to another school. I think I know the answer, but do I have to award her federal aid? She is not seeking a degree from our institution, but she claims that is her overall goal. Please advise. Message-ID: Many of you asked me to report back on the question about whether the "transferring" student can receive aid at my school. Some of you said yes, most said no. See below for the response from Joe Williams (who consulted w/ Kevin Campbell) from the DOE. Of course, all this is a mute point now, because (as Pam McConahay predicted) now the student has decided to stay here and get her Associate's degree before she transfers to OU. Good luck w/ this one Pam! I spent a lot of time on this yesterday only to be yelled at by an out-of-control student and now I will end up giving her aid anyway. I did, however, require a notarized letter from her stating that she intends to complete the program here and she understands that it is illegal to receive federal aid funds from a school in which she doesn't intend to get a degree from. Secondly, I told her that if I believe at any time that she misrepresented herself, I would be forced to report her as a possible fraud case to the DOE. We are a non-term program who awards based upon an award year of 24 hours consisting of 2 payment periods of 12 hours each. Our format is such that students attend one course at a time, one night a week for 5 weeks. The charges are placed on a student's account at the beginning of the month for any class they begin during that month. This has been the process for a couple of years. What results from the disbursement is a credit balance that either has to be returned to the student or it may stay on the student's account provided an authorization form is signed. Because students aren't physically in the class when the funds are disbursed these courses aren't considered allowable charges. We have been told that it would be against a GAAP rule to charge for these classes at the beginning of the payment period, and disburse only funds in excess of these charges. The FSA Handbook states that "Current charges: Charges assessed by the school for the current award year or the loan period for which the school certified or originated an FFEL or Direct Loan". "Allowable charges include: current charges for tuition and fees as defined in section 472 of the HEA". So it appears that our tuition charges are allowable charges and they can be considered current charges because they are for the current award year. Does any one have any insight into this problem? I know most of you are term based institutions who place an entire semester's charges on account up front, but I think if I read this rule right this would be the equivalent of placing charges for fall and spring semesters on the account in the fall. (assuming you could enroll in both semesters at once). Does this make sense or am I reasoning myself in a winding circle of confusion. The reason I bring this up this. We have had several students who won't sign the authorization to retain funds form and we have only had one charge on their account for the current month's class. They are receiving a huge credit balance refund. They subsequently withdraw from the program without completing the first course. We have been stuck sending money back to lender, as a result of the r2t4, that isn't on the student's account. I think word is spreading among the people who have done this and we have seen an increased amount of this activity. Any help you could provide would be greatly appreciated. Unfortunately (and we will whine along with you), it appears that the effective date is restrictive to "loans certified on or after 7/1/07". The only option we could think of besides certifying on or after 7/1/07, would be to go ahead and certify for the old loan limits prior to that, then certify a supplemental loan for the difference after 7/1/07. However, this option does increase your workload by certifying a second loan. If anyone else has thought of a way to process for the new loan limits in your office, we would be glad to hear about your alternative method. (The horn will cost $4000, but he currently has $1780 in his COA budget that he can use. He's requested that I increase his COA budget so that he can take an alternative loan to cover the cost of the new horn. He claims this is a school related expense because he uses it for school and plans to go to grad school as a french horn performance major and his auditions are coming up soon. So, is it a stretch to call this a personal/miscellaneous expense? My first reaction was, "heck no," but I want to make sure I'm being fair. You will notice that the number of awards for 2005-2006 is higher for many institutions while the total dollars disbursed may not be comparably higher. Keep in mind that in 2005-2006, we awarded additional students for the spring semester only. VERY IMPORTANT: If you are aware of any additional OTAG funds that you will be returning for late 2005-2006 disbursement cancellations, PLEASE contact me right away. We are working on our end of year reporting for federal LEAP/SLEAP, and as related to you in earlier communications, we are in a position to have to return some of the SLEAP funds that we expended in 2005-2006. This is the result of our inability to meet state funds matching requirements on expenditures due to some late and quite significant refunds we received for spring semester disbursements. If there are any additional 2005-2006 OTAG funds to be returned to us for cancellations, those refunds will have an affect on the amount of SLEAP funds we must return, and we need to be made aware of them now.
