Dennis Casey, R - Morrison). As originally introduced, HB 1421 would have required OKPromise college students to repay the program for any courses that they failed or from which they withdrew (text of original introduced version: http://webserver1.lsb.state.ok.us/cf/2011-12%20INT/hB/HB1421%20INT.DOC ). In the committee process, the bill was amended and the original language was replaced with language that would require that OKPromise students to be subject to the federal Satisfactory Academic Program (SAP)standards required of all students receiving federal aid (see text of bill as approved in committee and considered on the House floor: http://webserver1.lsb.state.ok.us/cf/2011-12%20FLR/HFLR/HB1421%20HFLR.DO C ). The primary new requirement that the federal SAP policy would impose on OKPromise students that is not currently in place is a quantitative requirement to complete at least two-thirds of the courses in which they enroll. However, on the House floor yesterday, much of the discussion of the bill apparently was about provisions as contained in the introduced version, not the version as passed in committee and as presented on the floor. The following article and press release provide some more background on this issue. (article in Friday morning's Daily Oklahoman) Oklahoma House passes guidelines for state-funded scholarships Oklahoma House members vote for bill thinking it would require college and university students on the scholarship program to pay back the state for courses they drop out of or flunk, but that provision had been taken out. BY MICHAEL MCNUTT mmcnutt at opubco.com Oklahoman Published: March 11, 2011 House members thought Thursday they were passing a bill that would require college and university students on a state scholarship program to pay the state back for courses they drop out of or flunk. But the measure simply stiffens requirements for students who receive money from Oklahoma's Promise scholarship program. House Bill 1421 would require students in the program to meet the same academic standards as students receiving federal financial aid. It passed 70-27, with all Democrats voting no. Due to a parliamentary procedure by Minority Leader Scott Inman, D-Del City, it will be delayed a couple days before moving to the Senate. The requirement maintains students have to pass at least two-thirds of their courses, said Ben Hardcastle, a spokesman with the State Regents for Higher Education. It would take effect for the 2012-13 academic year. Oklahoma's Promise pays for tuition at state schools for qualifying students whose family's income is less than $50,000. Students must maintain a 2.0 GPA for classes they take through their sophomore year and a 2.5 GPA for classes they take their junior year and after. Rep. Dennis Casey, the author of HB 1421, originally filed the measure requiring students in the program who flunk or drop out of the program to repay the state for those courses. He later filed an amendment that deleted that language and inserted the wording that students would have to follow the same guidelines as those on student aid. For nearly an hour, Casey, R-Morrison, debated the measure, maintaining it would require students who flunk or drop a course to repay the state. At one point, Rep. Ben Sherrer, D-Choteau, told Casey that he couldn't find any such language in the current form of the bill. Casey in an interview later gave no reason for his confusion. The approved guidelines make students ineligible if they do not complete most of the courses they are enrolled in, he said. They provide exemptions for students who withdraw due to circumstances such as a family emergency. (Revised press release issued by Rep. Casey at about 5:15 p.m. Thursday) NOTE: Due to amended language in the bill, the fiscal impact of the bill has changed and its effect has been modified. The $6.8 million figure is no longer accurate and there is no longer a "clawback" revision that would require students to reimburse OHLAP after receiving a payment. Two bills we are tracking were not heard on the floor and are considered dormant for the remainder of the 2011 session - HB 1618 which would have prohibited OKPromise from paying for remedial courses and SB 575 which would eliminate the eligibility of certain undocumented immigrant students for resident tuition rates (other legislation still alive would have the same effect). Following is the status of the bills we are tracking. [Also, further below is a legislative update from the State Regents office that also covers other non-financial aid legislation of interest to higher education - concealed weapons on campus, health insurance, retirement, academic and budget issues, etc.] Oklahoma's Promise: * HB 1421 - (Rep. Dennis Casey, R - Morrison and Sen. Jim Halligan, R - Stillwater) - as introduced, the bill would have required OKPromise college students to repay awards for courses from which the student withdraws after the add/drop deadline or if the student receives a failing grade. The State Regents, OneNet, and the colleges and universities are exempt from the legislation. The legislation passed out of the House on March 16, 2011 with a vote of 52-45. The emergency failed on the bill. OKPromise HB1421// Representative Dennis Casey and Senator Jim Halligan// The legislation would require OKPromise students to repay awards for courses from which the student withdraws or receives a failing grade in the course. UPDATE: The bill passed out of the House on March 10, 2011 with a vote of 70-27. The emergency failed. Representative Casey amended his bill to eliminate the language requiring students to repay for failed or withdrawn courses. The language now requires the student to maintain satisfactory academic progress. HB1618// Representative Gary Banz// The legislation would not allow the OKPromise award to pay for remedial courses. UPDATE: The legislation was not heard on the House floor this week. The House's second legislative deadline was March 17, 2011; therefore, all bills originating in the House must have passed out of the House in order to continue to advance in the legislative process. HB1663// Representative Leslie Osborn and Senator John Ford// The legislation would lower the second income limit applied at the time the OKPromise student enters college from $100,000 to $75,000. SB 610// Senator John Ford and Representative Todd Thomsen// The bill states the federal adjusted gross income should be used to verify the student's income does not exceed $100,000 at the time they enter college. Senator Crain offered a floor amendment which was adopted that adds the language "Undergraduate degree programs offered through Oklahoma State University/Tulsa shall not unnecessarily duplicate those undergraduate degree programs offered by Langston University Branch in Tulsa, as determined by the Oklahoma State Regents for Higher Education. She currently lives with her mother and grandparents. She claims that the grandparents support both her and her mother. Student and mother presented a Letter of Guardianship to the FA Office that states, "We, (student's grandparents), do solemnly swear that we will discharge all and singular duties of the guardianship of the person of the above-named minor, (name of student), according to state law and to the best of our ability." This letter is signed by a judge and was filed with the district court less than 2 months before the student turned 18. Mom did work in 2009 and based on what they reported as her income, she would be required to file a tax return, but hasn't. Should this student be considered Independent based on the guardianship status regardless of the living situation and continued relationship with student? Thank you in advance! Hope you are all well and this will be helpful to you. Yes, I'm still alive and kicking. People tell me I look younger now....of course, those are old people saying that and I do still dye my hair! I'm working part time at the Norman Senior Citizens Center as the site manager for the Congregate Meal program and enjoy it immensely. I don't have to get up early, I only work til after lunch, it doesn't interfere with basketball and it gets me out of the house. I joked that I wanted to retire and be one of the 'ladies who lunch', didn't realize I'd end up as a 'lunch lady' instead! I hope I can be as full of life when I'm their age (our oldest participant is 91 and still 'kicks butt' at canasta---that's a quote). Some of our employees grip about the paperwork .....they'd keel over if they saw a FAFSA, no less a FISAP. I try not to laugh too hard! Eugene is fine, he's still working and is still bald. Big Dog is still Big (boy is he, he's FAT) and we have 2 cats (Khan the longhaired Siamese male and Domino the tuxedo cat female). We also feed a colony of feral cats across the street (and yes, I've named them all and they answer to their names even though they won't let me pet them). Sadly, we lost all the little dogs (Lily the dachshund and Spanky the chihuahua) in the last year. The woman who runs the Senior Citizens Center has her first dachshund puppy so we get to swap 'wiener dog stories'. Who knows, I may get the bug and get another one yet! And, yes, OU retirees do get to keep their email addresses and I do use it as my primary email (primary schmimary, it is my only email address), so don't be strangers! Take care!!! P.S.
