I have the 2010 returns because she was selected for verification, and the 2011 returns because I was considering a special condition. All four returns show head of household. When looking at IRS Pub 17 (instructions for completing the 1040), it states that head of household can be claimed for both husband and wife if they were separated on the last day of the tax year. She has told me that she was separated the last day of 2010, that they got back together, and then were separated again on the last day of 2011. They filed their own taxes, but said they consulted with a tax specialist who told her she was doing everything legal, etc., etc. The FAFSA was completed on June 8, 2011 as a married status. When they filed their returns, April 15, 2011 for 2010 returns and March 1, 2012 for 2011 returns, they used the same address. When looking through the handbook and the references associated with it including RESOLVING CONFLICTING DATA 2009-10 FSA Handbook, School Eligibility & Operations, Chapter 10, 2010-11 FSA Handbook, AVG, Chapter 5, pages 106-108, 668.54(a)(3), 668.16(b)(3), 668.16(f) it basically says we can accept a statement from the student explaining their circumstances as documentation to resolve the conflict. I asked her to provide some legal documentation, but she said they weren't "legally" separated and have no such documentation. Any insight you could give me would be greatly appreciated. Although possible, I am finding it hard to believe that they were conveniently separated at just the right time, both years, so they could both file Head of Household and that they have no documentation to back up their story. One more twist to this story is that she received Pell at another school last semester. They obviously did not catch the fact that both were filing Head of Household and she received Pell based on those tax returns and a special condition they processed. Because of this, she doesn't understand why I am giving her such a hard time. Do you know if I am obligated to contact the previous school about their error so they can return Pell money? Gale M. "We're in the Game" promises to be one of our best conferences ever, and as you know Citizens Caring for Children will once again be the beneficiary of our charitable fund raiser. Since our entertainment Thursday night will be at a bowling alley, we've decided that "Up the Alley" is the perfect name for our exciting contest. The teams have been formed and you should be hearing from your team captains very soon. They all want to be the team that bowls a strike and not be one left with too many pins standing. The penalty for the losers hasn't been determined, but will certainly be entertaining! As we've mentioned in previous e-mails this year we are collecting gift cards to be used by mentors to the children in foster care. Student's mom reported single with zero income. For these situations, we ask for a Resource and Expense form to show the families expenses and how they were paid. The mom was very forthcoming with information about the fact that she has lived with her boyfriend for 9 years and he pays the expenses. (She had called the FAFSA help line and was told not to include any of his income so she didn't.) At first glance, we thought we'd just add his income as untaxed income to mom, but not include him in the family, and proceed. However, when we started digging a little deeper, we found some interesting things. According to the Verif Guide, it states in summary, that money received for housing, food, clothing, etc should be reported as untaxed income for the student. However, under "In-kind support", it says that if someone is allowing the student to live with them rent-free, that support is not included as untaxed income. We can't find documentation to back-up simply adding it to Mom's untaxed income as we had originally thought. So, since they have filed taxes together we checked into Common Law marriage to see if they should be treated as married. According to the Verification Guide, "Common-law marriage - If a couple lives together and has not been formally married but meets the criteria in their state for a common-law marriage, they should be reported as married on the application. If the state doesn't consider their situation to be a common-law marriage, then they aren't married; a dependent student would follow the rules for divorce to determine which parent's information to report. Check w/ the appropriate state agency concerning the definition of a common-law marriage." So, since the student is from Oklahoma, we checked to see if OK would recognize them as married. (This is where it gets interesting) According to the common law marriage website, it states that, "Oklahoma: To establish a common-law marriage, a man and worman must (1) be competent; (2) agree to enter into a marriage relationship; and (3) cohabit. However, under the heading "States that recognize common law marriage," it states "Oklahoma (possibly only if created before 11/1/98. Oklahoma's laws and court decisions may be in conflict about whether common law marriages formed in taht state after 11/1/98 will be recognized." A search on the state of OK site had no results for "common law." Clear as mud, right? After all that, we are as confused as when we started. What would you do in this situation? On Wednesday, Governor Fallin signed HB 2970 which provides an appeal process for students at public schools who are denied a high school diploma due to failure to meet the end-of-instruction (EOI) testing requirements that are part of the high school graduation requirements for 2012 seniors. As discussed at the OASFAA conference last week, failure to receive a high school diploma could cause the student to be ineligible for federal financial aid, Oklahoma's Promise, OTAG and many other scholarships and grants. Energy SB 1096// Senator Brian Bingman and Representative Scott Martin// The legislation directs state agencies and higher education to reduce energy costs for all state buildings. The Office of State Finance will oversee the implementation of an organizational behavior-based energy conservation program. The program will target a cumulative energy savings of at least twenty percent (20%) by the year 2020 when compared to the 2012 fiscal year utility expenditures. Retirement/Health Insurance HB 2321// Representative Randy McDaniel and Senator Patrick Anderson// The legislation modifies the number of unused sick days that can be used for creditable service in the Teachers' Retirement System and the OK Public Employees Retirement System. For members who join the System on or after November 1, 2012, unused sick leave shall be credited at the same rate but not used to round up to another year. Carry Over Bills from Last Legislative Session Concealed Weapons/Open Carry HB 2522// Representative Steve Martin and Senator Greg Treat// The legislation allows for unconcealed weapons in additional areas and times without a handgun license issued pursuant to the Oklahoma Self Defense Act. The legislation allows individuals to carry an unconcealed weapon if they are issued a document from an NRA instructor or if the firearm is carried in a holster. UPDATE: The bill passed out of the Senate on April 24, 2012 with a vote of 39-2. Senator Treat offered a floor amendment that will allow an individual to carry a concealed or unconcealed weapon without a permit for the lawful self-defense and self-protection or any other legitimate purpose in or on property that is owned, leased, rented, or otherwise legally controlled by the person. SB 1785// Senator Steve Russell and Representative Leslie Osborn// The legislation allows out-of-state persons in compliance with the Oklahoma Self-Defense Act to carry a concealed firearm in the State. SB 1733// Senator Anthony Sykes and Representative Jeff Hickman// The legislation allows justices and judges to carry weapons in any courthouse in Oklahoma. The legislation also allows for unconcealed weapons in certain areas.
