In a somewhat unusual turn of events, on Thursday, March 1, HB 2679 failed narrowly on the House floor by a vote of 48 yes, 36 no (15 not voting; 2 vacancies; bills must receive at least 51 yes votes in the 101 member House to pass). HB 2679 is the bill that would pro-rate the OKPromise award based on the parents' income at the time of the second income check (see the bill text at: http://webserver1.lsb.state.ok.us/cf/2011-12%20FLR/HFLR/HB2679%20HFLR.DO C ). However, the author of the bill lodged a motion that will allow him to request another vote on the bill within 3 legislative days, if he so chooses. The discussion of the bill on the House floor ranged widely over various aspects of the OKPromise program (and some of the facts discussed were not always completely accurate). Effective November 1, 2012, institutions of higher education, common education and career technology centers may obtain workers' compensation insurance through third-party vendors. Additionally, effective November 1, 2012, all state agencies, boards and commissions shall obtain workers' compensation insurance through the Office of State Finance. The state Risk Management Administrator shall manage the process and shall ensure that information needed for the quoting process shall be available no less than sixty (60) days before the expiration date of the current policy. In addition, the Risk Management Administrator shall have oversight authority of the claims and risk management processes of any private carrier or insurance agency insuring the risk. OKPromise HB 2679// Representative Gary Banz and Senator Clark Jolley// The legislation alters the second income check so that the amount of tuition a student would receive from the OK Promise scholarship is based on their income level. A student would receive 100% of the scholarship if their parent's income was below $50,000. A student would receive 90% of the scholarship if their parent's income is greater than $50,000 but less than $60,000. A student would receive 80% of the scholarship if their parent's income is greater than $60,000--$70,000. A student would receive 70% of the scholarship if their parent's income is greater than $70,000 but less than $80,000. A student would receive 60% of the scholarship if their parent's income is greater than $80,000 but less than $90,000. And finally a student would receive 50% of the scholarship if their parent's income is greater than $90,000 but less than $100,000. The bill failed on the House floor last Thursday but was reconsidered yesterday and passed by a vote of 54 - 36. There was no discussion or debate about the bill during yesterday's voting. The bill now moves to the Senate. The bill was passed without questions or debate. The bill was also amended of the floor, without questions or debate, to include language that would require state system institutions to offer students needing remediation a choice between taking a regular non-credit remedial course or a credit-earning course that also provides the remedial support (see the text of the bill for the actual language of the amendment in Section 2 of the bill). The bill now heads to the Senate for consideration. I have the 2010 returns because she was selected for verification, and the 2011 returns because I was considering a special condition. All four returns show head of household. When looking at IRS Pub 17 (instructions for completing the 1040), it states that head of household can be claimed for both husband and wife if they were separated on the last day of the tax year. She has told me that she was separated the last day of 2010, that they got back together, and then were separated again on the last day of 2011. They filed their own taxes, but said they consulted with a tax specialist who told her she was doing everything legal, etc., etc. The FAFSA was completed on June 8, 2011 as a married status. When they filed their returns, April 15, 2011 for 2010 returns and March 1, 2012 for 2011 returns, they used the same address. When looking through the handbook and the references associated with it including RESOLVING CONFLICTING DATA 2009-10 FSA Handbook, School Eligibility & Operations, Chapter 10, 2010-11 FSA Handbook, AVG, Chapter 5, pages 106-108, 668.54(a)(3), 668.16(b)(3), 668.16(f) it basically says we can accept a statement from the student explaining their circumstances as documentation to resolve the conflict. I asked her to provide some legal documentation, but she said they weren't "legally" separated and have no such documentation. Any insight you could give me would be greatly appreciated. Although possible, I am finding it hard to believe that they were conveniently separated at just the right time, both years, so they could both file Head of Household and that they have no documentation to back up their story. One more twist to this story is that she received Pell at another school last semester. They obviously did not catch the fact that both were filing Head of Household and she received Pell based on those tax returns and a special condition they processed. Because of this, she doesn't understand why I am giving her such a hard time. Do you know if I am obligated to contact the previous school about their error so they can return Pell money? Gale M. Retirement/Health Insurance HB 2321// Representative Randy McDaniel and Senator Patrick Anderson// The legislation modifies the number of unused sick days that can be used for creditable service in the Teachers' Retirement System and the OK Public Employees Retirement System. For members who join the System on or after November 1, 2012, unused sick leave shall be credited at the same rate but not used to round up to another year. Instead, any additional months of unused sick leave credit shall be added to other service credit without rounding.
