Appropriations/funding/bonds SB 1353// Senator Patrick Anderson and Representative Jason Murphey // The legislation requires the Oklahoma State Regents for Higher Education to submit the master lease list to every member of the Legislature, not just the Governor, Pro Tem, and Speaker. UPDATE: The legislation was signed into law by Governor Fallin on Tuesday, April 19, 2016. HB 3058// Representative Tom Newell and Senator Greg Treat// The bill directs the Office of Management and Enterprise Services (OMES) to reconcile all state agency revolving funds following the reconciliation criteria created by the Director of OMES by the first Monday of August each year. Proceeds realized by the reconciliation are to be deposited in the Special Cash Fund for the certification by the State Board of Equalization for expenditure authority in the following fiscal year. Telecommunications/ IT HB 2616// Representative Todd Thomsen and Senator Eddie Fields// The legislation changes the administration of the Oklahoma Universal Service Fund from a litigation-based system to an administrative process that attempts to create certainty and clarity for service bids sought by schools and hospitals. Data and Reporting SB 1117// Senator Nathan Dahm and Jason Murphey// The legislation allows a public body to maintain a quorum of members for the duration of a meeting whether the members are present at the meeting site or via videoconference. HB 2155// Representative Jon Echols and Senator Clark Jolley// The legislation creates the Transparency in Private Attorney Contingency-Fee Contracts Act which requires the Attorney General (AG) to make a written determination, prior to the state entering into a contingency-fee contract with a private attorney, whether the decision is both cost-effective and in the public interest. HB 3028// Representative John Paul Jordan and Senator Jim Halligan// The legislation requires the Oklahoma State Regents, in conjunction with the Oklahoma Department of Commerce, to annually prepare an economic security employment report of employment and earning outcomes for degrees earned at colleges and universities. HB 3166// Representative Jeff Hickman and Senator Marty Quinn// The legislation requires additional information to be included in the State Regents? annual report to the legislature. The legislation would now require the report to include: 1. The budget prepared by the State Regents setting out in detail the necessary expenses of the State Regents for the next fiscal year; 2. The budget requests or proposals submitted by each institution to the State Regents for the next fiscal year; 3. The funding formula or allotment system used by the State Regents to allocate money to each institution, including a description of the functional goals of the formula or system for distributing funds to each institution; 4. A calculation of any differences in the budget requests amounts for each institution and the actual amounts allocated to each institution, including an explanation for any differences; and 5. Any other data considered relevant by the State Regents. Additionally, by January 1 of each year, each institution of The Oklahoma State System of Higher Education shall submit a report to the Governor, the President Pro Tempore of the Senate, the Speaker of the House of Representatives, and the minority floor leaders and education committee chairs of both houses of the Oklahoma Legislature, which includes: 1. A copy of reports submitted to the State Regents, which itemizes the tuition and fees for each institution by campus or location; and 2. The total budget of each institution for the previous fiscal year, including the amount of revenue received from tuition and fee and other sources and expenses for each campus or location. HB 2527// Representative Dennis Casey and Senator Jason Smalley// The legislation brings the Oklahoma School Testing Program Act into compliance with the federal Every Student Succeeds Act. It allows school districts to use local assessments that are nationally recognized for students at the secondary level in place of a state-mandated assessment. Local assessments approved by the State Board of Education and used in place of a state assessment will be considered state-mandated assessments. Results of the assessments will be reported to districts no later than June 1 of each year. The legislation repeals the language that created the End of Instruction exams. A violation of the measure would result in a misdemeanor for the donor and the person would be subject to a fine or imprisonment or both. Eligible students meeting the awarding criteria listed below can be claimed for payment of their OTAG awards upon the institution?s submission of a successful and timely award claim: ? EFC 1700 or lower ? FAFSA receipt date March 1, 2016 or earlier The Award Payment Schedule reflects 5234 as the maximum eligible EFC, which is consistent with Pell in 2016-2017. The maximum EFC primarily serves as a means to identify the total number of eligible students who could be awarded if sufficient funds were provided. Also attached is a list of institutions that participate in the OTAG program and their flat-rate award amounts for 2016-2017 (one amount for full-time undergraduates and one amount for part-time undergraduates). The amounts shown are for the full award year. Important dates/deadlines that institutions and the State Regents? office must meet are listed in the attached Timelines and Procedures for 2016-2017. These have been established in an effort to maximize the efficiency of the administration of the OTAG program to best benefit students statewide. All institutions are expected to adhere to the schedule, and everyone?s cooperation is appreciated. These documents are being added to the OTAG information section of the Financial Aid Resources for Institutions website http://www.okhighered.org/admin-fac/FinAidResources/ . We are currently awaiting 2016-2017 OTAG reporting system start up. Based on the latest information provided by our IT department, we anticipate that pre-populated OTAG Award Claim Forms for use by campus financial aid staff as ?work copies only? will be available shortly. The actual Award Claim Form process for standard term fall semester disbursements will begin closer to the beginning of the fall semester, and more information in this regard will be forthcoming. Important Reminders: * OTAG recipients must be eligible residents of Oklahoma per the State Regents? residency policy. Appearance on a pre-populated claim is not intended to confirm Oklahoma residency. Pre-populated claims are created by selecting otherwise eligible students that self-report Oklahoma residency on the FAFSA and also indicate intent to attend an eligible Oklahoma institution. Non-residents and ineligible undocumented students may appear on pre-populated claims and should be removed per OSRHE residency policy. Many DACA eligible students receive a valid social security number for work purposes only and may believe they are eligible for aid. DACA students filing a FAFSA are not eligible for OTAG and should be removed from the claim unless the specific requirements outlined in the Regent?s residency policy are met. (See 3.17.6 (4)) * OTAG does not send award notices to students. We are relying on institutions to include OTAG award information in their student award notices. Please realize that if institutions do not include OTAG awards in their student award notification process, the students will receive no confirmation that they are receiving an OTAG award. We?re counting on institutions to be the messengers. * Other than OTAG?s Oklahoma residency requirement and the statutory limitations on the types of institutions that are eligible to participate, student eligibility requirements for OTAG are the same as student eligibility requirements for Pell. Generally, if you cannot award Pell funds to a student, you cannot award OTAG funds to the student. * Remember the Regent?s residency policy change regarding military personnel remains in effect for all schools for 2016-2017. There is immediate in-state status for all full-time active duty military personnel, spouse and dependent children stationed in Oklahoma. Legislation now extends in-state status to certain veterans, spouses and dependent children as well. ROTC participants are also now eligible for in-state status. This makes these students eligible for OTAG if all other requirements are met. If these students have listed a state other than Oklahoma on the FAFSA, they will not automatically appear on your pre-populated claim forms. Please be sure to add these students to your claim. Let's say your maximum time frame for a student in an Associate's Degree Program is 90 hours; that student brings 10 hours of AP credit with her and the hours are posted on her academic transcript. You could add the 10 hours to her maximum time and document why you have added the hours. This is only an issue when the student is approaching or hits the max. If your admissions office can identify those students and their AP hours up front for you all the better. We did not require those students to appeal if this was the reason they were maxed out.
