Following is this week’s legislative update.  As you are aware, there are three OKPromise bills remaining.  We are closely monitoring and have continued to have discussions with Speaker McCall’s staff about HB 3591.  Currently, the bill contains “last dollar” language stating that OKPromise awards “shall be made only after all other grants and scholarships received by an eligible applicant are exhausted.”  However, the bill does not specify the costs to which grants and scholarship awards might be limited (currently, OKPromise awards are subject to “cost of attendance” limits).  We’ll try to keep you updated on any developments related to this bill and HB3592.  The next legislative deadline is Thursday, March 15 when bills must be passed on the floor of their house of origin.

Special Legislative Session


House Bill 1020 (Representative Kevin Wallace and Representative Dennis Casey / Senator Kim David and Senator Eddie Fields) General appropriations bill. Cuts every agency by .66 percent.

House Bill 1022 (Representative Kevin Wallace and Representative Dennis Casey / Senator Kim David and Senator Eddie Fields) Provides funding to Health Care Authority to prevent budget crisis. This protects accreditation for medical universities.

House Bill 2528 (Representative Bobby Cleveland and Senator Jack Fry) Allows state employees to pursue civil action in whistleblower cases.

House Bill 2767 (Representative Mike Osburn) Rewrites the Oklahoma Personnel Act.

House Bill 2876 (Representative John Michael Montgomery and Senator Nathan Dahm) Creates Rules and Regulations Review Commission to conduct an independent review of all rules and regulations currently filed in the Oklahoma Administrative Code.

UPDATE: Passed out of House Administrative Rules Committee 5-1 on Wednesday, February 14. Laid over on House Floor on Tuesday, February 27. Senator Nathan Dahm added as Senate author.



House Bill 2911 (Representative Mickey Dollens and Representative Leslie Osborn) Creates the Work-based Learning Program coordinated by the Governor’s Council on Workforce and Economic Development to increase the number of registered apprenticeships and internship programs in the state to an aggregate of 20,000 by the end of 2020. Requires participating partners (State Department of Education, State Department of Career and Technology Education, and the State Regents for Higher Education) to provide time and expertise and to assist publishing an annual progress report showing each state agency's steps and accomplishments toward meeting statewide workforce goals.

House Bill 3054 (Representative Kyle Hilbert) Adds the State Department of Education, the State Board of Education, and the Oklahoma Department of Career and Technology Education to those exempted from the IT Consolidation Act.

UPDATE: Passed out of the House Higher Ed and CareerTech Committee 6-3 on Monday, February 13.



House Bill 3138 (Representative Mike Ritze and Senator Josh Brecheen) No state employee can receive a salary greater than 90% of the CEO of that agency, board, or commission.

UPDATE: Passed out of the House General Government Oversight and Accountability Committee 4-2 with a committee substitute that exempts medical professionals on Thursday, February 15. Senator Josh Brecheen added as Senate author.



House Bill 3139 (Representative Mike Ritze and Senator Josh Brecheen) No agency, board or commission CEO can receive a salary greater than the Governor.

UPDATE: Passed House General Government Oversight and Accountability Committee 4-2 on Thursday, March 1. Senator Josh Brecheen added as Senate author.



House Bill 3140 (Representative Ritze and Senator Nathan Dahm) Sets Governor’s salary to three times the base pay of Legislature, and the Lieutenant Governor’s salary salary at 80% of the Governor’s salary. Sets salary for other agency heads equal to the Governor’s salary.

House Bill 3208 (Representative Mark Lepak and Senator Greg Treat) Allows the Governor to appoint the Lieutenant Governor as a cabinet secretary and reorganizes cabinet, cabinet positions and compensation.

UPDATE: Withdrawn from House Government Modernization Committee and referred to House Rules Committee. Passed House Rules Committee 6-1 on Wednesday, February 28. Senator Greg Treat added as Senate author.



House Bill 3209 (Representative Mark Lepak and Senator Greg Treat) Changes Governor’s appointment powers. Proposes certain appointments be made by the Governor and compensation set by such. Removes power to promote from boards of such institutions.

UPDATE: Withdrawn from House Government Modernization Committee and referred to House Rules Committee. Senator Greg Treat added as Senate author.



House Bill 3280 (Representative Chris Kannady) Deletes ability of state employees to accumulate more than the maximum annual leave limit, provided that such excess is used during the same calendar year in which it accrues or within 12 months of the date on which it accrues.

House Bill 3353 (Representative Sean Roberts) allows a person in possession of a valid handgun license or who meets the criteria and presents a valid military identification card to carry a handgun while scouting

House Bill 3587 (Speaker Charles McCall) The Governor shall have the power to remove any gubernatorial appointment on any agency, board or commission at any time.

House Bill 3597 (Speaker Charles McCall and Representative Mike Osburn) No chief executive officer of any board, commission, department or program in the executive branch of state government shall be eligible for appointment as a cabinet secretary.

House Joint Resolution 1048 (Representative Mark Lepak and Senator Greg Treat) Constitutional amendment making offices of State Treasurer, Superintendent of Public Instruction, Commissioner of Labor, and Insurance Commissioner appointed offices.

Senate Bill 925 (Senator Roger Thompson and Representative Mike Osburn) Raises the requirement for an agency cost analysis report when privatizing a function from $100,000 to $1 million. Changes the privatization process.

Senate Bill 951 (Senator Nathan Dahm and Representative Tim Downing) Bars agencies from entering into contingency-fee contracts with private attorneys unless approved by the Attorney General.

Senate Bill 1011 (Senator Josh Brecheen) An agency director shall be authorized to place a moratorium on pass-through funding during a fiscal year when the agency's total appropriations are less than the prior fiscal year's total appropriations.

Senate Bill 1404 (Senator Josh Brecheen and Representative Mike Ritze) The maximum salary for all staff, subordinates and statutorily-created agency employees shall not exceed ninety percent (90%) of the salary of the Governor.

Senate Bill 1013 (Senator Josh Brecheen and Representative George Faught) The State Auditor and Inspector shall set accounting practices for all state agencies based upon Generally Accepted Accounting Principles.

Senate Bill 1270 (Senator Adam Pugh) Requires an itemized request justifying “every dollar” every four years, beginning in 2020, from every agency.

Benefits for State Employees – Health & Retirement


House Bill 1340 (Representative Randy McDaniel and Senator Greg Treat) Puts out a one-time distribution of $1,000 to retired Oklahoma firefighters, police, justices and judges, Law enforcement, Teachers and public employees; requires all further distributions other than those defined by the provisions of respective retirement plans to be authorized by the legislature; makes all further such distributions be made no more frequently than once every 6 years.

House Bill 2523 (Representative Randy McDaniel and Senator Julie Daniels) Changes state unemployment benefits. Specifically mentions educational service contract employees and modifies when they can enroll in unemployment benefits.

Requires health service be provided to patients that disclose possession of a firearm except for in certain circumstances. Provides for fines to be imposed for specific violations.



Senate Bill 275 (Senator Dahm) Prohibits public officers and employees from using public money to promote gun control. Modifies language specifying weapons subject to restriction. Specifies the conditions under which a court will award expenses in a civil action suit




Common Education



Senate Joint Resolution 70 (Senator Stephanie Bice) Directs to a vote of the people a proposed amendment to the constitution. Expands uses allowed by school districts for ad valorem taxes.

Senate Bill 1354 (Senator Ervin Yen) Graduates of medical schools located in other countries which give any type of monetary contribution to a health facility located in this state shall not be given preference for residency programs over graduates of a medical school located in this state.
