I'm not fully able to address whether or not state agencies and higher education institutions will be considered one employer once the two begin operating under separate FEIN's.  Matt may be able to provide a legal opinion to answer that question.  State agencies will continue to count qualifying service at higher education institutions for FMLA eligibility and leave accruals.  State agencies will not count hours worked at higher education institutions with respect to calculating overtime.

Rachell,

The employees who work full-time for another state agency and part-time for Regents will no longer be eligible for OT for the time they work at Regents.

In the past FMLA as well as FLSA time has been cumulative for all state service.  For example:  When an employee works full-time for another state agency and does part-time work for our agency , the time worked for our agency is considered over-time because we were looked at as one state employer.  Will this remain the case after the decoupling?
