[Oacrao-l] Enrollment for Undocumented Students

Dr. Beauchamp,
I have always relied on 3.18.6 to guide in admission of an undocumented students because section 3.9.4 does not address undocumented students. Section 3.9.4 only addresses international students (who would be non-immigrants with a student visa) and non-native speakers of English, and  neither of these seem to fit for undocumented.  However, we have recently had undocumented students applying that did not graduate from an Oklahoma high school which 3.18.6 does not cover. I think it would be helpful to address undocumented students in section 3.9 for admission purposes especially if 3.18.6 is removed.

OACARO Colleagues,

I am starting with this group first regarding our question.  As you are aware, current Oklahoma State Statute allows undocumented students to be eligible for enrollment and out-of-state tuition waivers providing they meet the guidelines in policy.

Due to the motion filed by AG Drummond ending this practice, we are in the process of updating the policy.  Our legal council is considering just eliminating 3.18.6 in its entirety.  However, as I noted in bold above, by doing so, it seems that this would also prohibit our institutions from even enrolling undocumented students - regardless of student status.

My question is - if 3.18.6 were eliminated, would our institutions interpret the policy to mean that they could not enroll undocumented students AT ALL?
