FYI - Please see the e-mail below that was sent today from Chancellor
Johnson to the presidents of the state system institutions. The
document attached to the e-mail provides guidance about the eligibility
of undocumented immigrants for enrollment and resident tuition at state
system institutions as well as their eligibility for state financial aid
programs.
If this issue impacts your institution, please read the document
carefully and keep it for reference purposes. If you have questions,
please see the contact information on page 7 to direct your question to
the appropriate staff person at the State Regents' office.

Subject: Undocumented persons - eligibility for enrollment,
resident tuition and financial aid under HB1804 and SB820
During its 2007 session, the Legislature passed, and the Governor
subsequently approved, two items of legislation which pertain to the
issue of immigration. Both of these items, HB1804 and SB820, are now in
effect, and both include provisions which must be implemented by The
Oklahoma State System of Higher Education.
HB1804 includes provisions regarding eligibility for enrollment,
resident tuition and financial aid other than Oklahoma's Promise
(OHLAP), while SB820 includes provisions regarding eligibility for
Oklahoma's Promise. Please also note that, at their October 25, 2007
meeting, the State Regents amended their policy regarding eligibility
for enrollment, resident tuition and financial aid (OSRHE Policy 3.18.6)
so as to conform with HB1804.
The attached memo is intended to provide guidance to those persons at
your institution who will be directly involved in implementing the
provisions of HB1804, SB820 and the new State Regents policy. It is
suggested that those persons read the memo as soon as possible, and then
keep it handy to be referred to and used as a checklist when analyzing
the eligibility of any particular student.
HB1804 and SB820 raise complicated issues. The OSRHE staff and I
realize that you and your staff may have questions after the memo is
reviewed. Please contact the appropriate OSRHE staff person listed on
page 7 of the memo regarding any questions. If necessary, the memo will
be updated in the future to address those questions.
