Below is the state legislative update for April 1 - 5.

SB 432, the "Oklahoma's Career Promise Act", would expand Oklahoma's Promise to include certain career technology programs.  The bill provides a limit of up to $10 million for additional annual costs. The bill was passed in the House Appropriations Subcommittee on Career Technology Education on Wednesday by a 3-2 vote (you can listen to an audio recording of the subcommittee discussion at http://www.okhouse.gov/Committees/CommitteeMembers.aspx?CommID=174&SubCommID=63 ; click on "Archived Committee Audio" and then click on the 4-3-2013 file).  The bill is next scheduled to be heard in the full House Appropriations and Budget Committee next Wednesday, April 10.

HB 2062// Representative David Derby and Senator Clark Jolley// The legislation directs the State Chief Information Officer to annually complete an assessment of all the information technology and telecommunication systems of all state agencies in the state, including the systems of higher education and OneNet.
UPDATE:  The legislation passed out of the Senate General Government Committee on March 25, 2013.  The bill has also been assigned to the Senate Appropriations Committee.  The Senate General Government moved to strike the title on the bill.


OKPromise

HB 1721// Representative Leslie Osborn and Senator AJ Griffin// The legislation eliminates the language creating the second income check of $100,000 before a scholarship recipient enters college.
UPDATE:  Representative Lee Denney has filed a floor amendment to be considered which would set the second income check at $60,000.  This would make a student ineligible for the OKPromise scholarship award if their parents had an AGI greater than $60,000 at the time the student entered post-secondary education.  The legislation has been assigned to the Senate Education Committee and Senate Appropriations Committee.

HB 1770// Representative Todd Russ and Senator Don Barrington// The legislation allows certain career tech courses to be used to satisfy the OKPromise high school curriculum requirements.
UPDATE:  The legislation has been assigned to the Senate Education Committee and the Senate Appropriations Committee.  The legislation passed out of the Senate Education Committee on March 25, 2013.  The Senate Education Committee moved to strike the title on the bill.

SB 432// Senator John Ford and Representative Lee Denney// The legislation expands the OKPromise program to pay the tuition and fees for students who are pursuing certification in a postsecondary vocational-technical program or program offered at an institution within The Oklahoma State System of Higher Education identified by the Executive Director of the Oklahoma Department of Commerce.
UPDATE:  The legislation was assigned to the House Appropriations Subcommittee on Career Tech on April 3, 2012.  The legislation is scheduled to be heard the House Appropriations committee on April 10, 2013.

SB 399// Senator Tom Ivester and Representative David Perryman// The legislation creates an exception for students in the 11th and 12th grade to sign up for the OKPromise scholarship program if their parent or guardian passes away.
UPDATE:  The legislation has been assigned to the House Appropriations Committee.

HB 1465// Representative Jason Murphey and Senator David Holt// The legislation requires state agencies to develop a management and performance report to include information regarding an agency's fee structure, the calculating of fees, and measuring customer satisfaction.
UPDATE:    The legislation has been assigned to the Senate Appropriations Committee and the Senate Appropriations Subcommittee on General Government. This legislation passed out of the Senate Appropriations Subcommittee on General Government and Transportation on March 27, 2013.  The legislation passed out of the Senate Appropriations Committee on April 3, 2013.  The Senate Appropriations Committee moved to strike the title on the bill.

SB 171// Senator John Ford and Representative Lee Denney// The legislation alters the membership of the Career Tech Governing Board.  The bill removes the State Superintendent from the Career Tech Board.  Additionally, the bill directs the Governor to appoint two members of the State Regents to serve as ex officio voting members.
UPDATE:  The legislation has been assigned to the House Higher Education Committee.

SB 867 // Senator Clark Jolley and Representative Lee Denney// The legislation transfers the Oklahoma Educational Television Authority to the Oklahoma State Regents for Higher Education.
UPDATE:  The legislation has been assigned to the House Government Modernization Committee.

SB 156// Senator Jim Halligan and Representative Lee Denney// The legislation requires the State Regents to report the following to the legislature on all baccalaureate programs offered, the average five-year graduation rate for first-time college enrollees; the average debt incurred by students who incurred student loan debt to complete their studies; the percentage of students employed within the discipline of their studies upon graduation; and information presented at the conclusion of the sophomore year of study to students and their parents reporting the projected level of debt incurred by those students who, in obtaining their degree, incurred debt, and information detailing other academic programs which are in high demand in the Oklahoma economy.
UPDATE:  The legislation passed out of the House Higher Education Committee on March 28, 2013.  The legislation passed out of the House Calendar Committee on April 3, 2013.

HB 1910// Representative TW Shannon and Senator Brian Bingman// The legislation establishes an Asset Management Board.  The Board will be responsible for liquidating underutilized assets owned by the entities under its direction to pay for the upkeep of other state assets, including the State Capitol Building.  The legislation authorizes the Office of Management and Enterprise Services (OMES) to recommend the sale of state properties based on the value of the property and the potential for a net gain to the state; Modifies procedures for state entities to dispose of real property; Requires the appropriate county officials to file and record instruments vesting the state's right to, or interest in, lands or minerals or to adjust irregularities on those instruments at the request of OMES without filing or recording fees; Modifies the duties of the Long-Range Capital Planning Commission (LRCPC) to include preparing an annual capital plan budget for addressing state capital facility needs for the ensuing 8 years and modifies the components of the capital plan;  Directs the LRCPC to decrease the amount of property owned by the state and to better maintain and utilize the state's real property assets;  Prohibits state entities from entering into a lease agreement, purchasing property or constructing a building without approval of the LRCPC and the State Governmental Technology Applications Review Board;  Consolidates the Capitol-Medical Center Improvement and Zoning Authority into the LRCPC; Provides for the eventual termination of the Oklahoma Building Bonds Commission; and Repeals the Alternative Use Study for state-owned property, the Capitol-Medical Center Improvement and Zoning Commission, the State Facility Capital Needs Committee, the State Capitol Preservation Commission, various sections of obsolete language regarding building bonds, and provisions regarding the release of an expired option to purchase land.

HB 1990// Representative David Brumbaugh and Senator Greg Treat// The measure creates the Department of Real Estate Services.  The department will now perform the following duties. 1. Determine or approve the agency's scope of a project and required services as provided in the Public Facilities Act; 2. Issue solicitations for construction manager and consultant services; 3. Conduct evaluations, interviews, selection, contract negotiation, and fee negotiation processes; and 4. Provide contract management services after award of a construction management or consultant contract.

UPDATE:  The legislation has been assigned to the Senate General Government Committee and the Senate Appropriations Committee.  The legislation passed out of the Senate General Government Committee on March 25, 2013.

SB 56// Senator Brian Crain and Representative Lee Denney// The legislation indicates that OSRHE shall not issue any waivers or allow a student to graduate with an accounting degree without meeting the minimum number of hours taught by faculty being satisfied.
UPDATE:  The legislation has been assigned the House Higher Education Committee.

SB 58// Senator Brian Crain and Representative Lee Denney// The legislation indicates that the Langston Board of Trustees may establish a branch campus in Tulsa.  The legislation currently statue uses the word shall.
UPDATE:  The legislation has been assigned to the House Appropriations Committee.

SB 59// Senator Brian Crain and Representative Lee Denney// The legislation directs the Oklahoma State Regents for Higher Education to establish an accounting degree program at Oklahoma State University-Tulsa.
UPDATE:    The legislation has been assigned to the House Appropriations Committee.

SB 891// Senator John Sparks and Representative Emily Virgin// The legislation creates a cause of action for any public or private institution on a third party who engages in conduct in violation of the rules of the governing authority that causes the educational institution to incur sanctions by the governing authority or other economic penalties or losses. The educational institution may recover damages in the amount of the sanctions, penalties or economic losses incurred as a result of the conduct of the third party.
UPDATE:  The legislation has been assigned to the House Judiciary Committee.

SB 49// Senator John Sparks and Representative Emily Virgin//  The legislation expands the Oklahoma Mutual Aid Compact to allow public universities which maintain CLEET-certified law enforcement agencies to elect to be considered jurisdictions under the provisions of the compact and shall retain the right to later withdraw from the system.
UPDATE:  The legislation passed out of the House Public Safety Committee on March 27, 2013.

SB 682// Senator Don Barrington and Representative Lisa Billy// The legislation defines the purpose of the Oklahoma State University Fire Service Training and outlines the educational duties and mission.
UPDATE:  The legislation passed out of the House Higher Education Committee on April 2, 2013.


Textbooks

HB 1434// Representative Mike Turner and Senator Ralph Shortey// The legislation creates legislative intent to give students more information about the textbook, instructional material and other costs associated with each course.  Specifically, higher education faculty and staff members when developing a syllabus for a course to must include in the syllabus the cost of: a. all instructional materials required for the course, b. any license which the student may be required to acquire in order to access on-line or supplemental course-specific material and c. any laboratory fees required for the course.

SB 495// Senator Clark Jolley and Representative Scott Martin// The legislation allows the Oklahoma State Regents for Higher Education utilize the prudent man standard when dealing with investments.
UPDATE:  The legislation passed out of the House Appropriations Committee on April 3, 2013.  The House Appropriations Committee restored the title on the bill.

Bonds and Master Lease

SB 653// Senator Clark Jolley and Representative Scott Martin// The legislation relieves the Oklahoma State Regents for Higher Education of the responsibility of constructing and financing the Medical Examiner Office and directs the Oklahoma Capitol Improvement Authority to issue bonds for the project.
UPDATE:  The legislation has been assigned to the House Appropriations Committee.


Tuition Waivers


SB 423// Senator John Sparks and Representative Emily Virgin// The legislation allows for students who have received a diploma from a public Oklahoma High School to receive resident tuition.  The student must reside in the state to receive the resident tuition.
UPDATE:  The legislation has been assigned to the House Appropriations Committee.  The legislation is scheduled to be heard in committee on April 10, 2013.



SB 486// Senator Frank Simpson and Representative Pat Ownbey// The legislation allows for  a one hundred percent (100%) disabled veteran of any branch of the United States Armed Forces, their spouse and dependents, to attend any state support institution without payment of tuition or fees.

UPDATE:   The legislation passed out of the House Appropriations Committee on March 25, 2013.  The legislation was amended to say the member must have been discharged or released under conditions other than dishonorably from the military while at a military installation located in Oklahoma.
