[Oasfaa] Work study question.

I reached out to the askafed.ed.gov email and Kevin Campbell responded with the following. I submitted the info to my administration and we are changing our policy. The student is happily employed in our library this coming fall!

"I don’t see anything in Title IV regs or the HEA that would grant a school the latitude to exclude an otherwise eligible student from benefitting from any T4 program, including FWS.

If there is some other Federal law or reg, or state law or reg, that prohibits a student from working in a particular capacity, then you would have to follow that law or reg. But, I would be curious to see what law or reg is being cited for this purpose.

We hope you find this information helpful. We have addressed the issues as described in your inquiry. We are not aware of all your institution’s policies, procedures and practices, some of which could affect the applicability of this guidance. Your institution must comply with all statutory or regulatory provisions governing the Title IV, HEA programs."

Subject: [Oasfaa] Work study question.

Happy Monday! We have a 16 year old student that is eligible for title iv. He was awarded work study and found a job. However now we learn that OBU has a policy that students under 18 cannot work on campus. They are citing osha and dept of labor? I’ve checked the regs and AskRegs and can’t find age requirements but I do see that a school can’t withhold work study for things like failing a background check or have a gpa requirement for work study elig. To me, age would be a similar thing.

I’d like input as to your policies and if this has ever been an issue at your school.

Thanks in advance
Jonna
