[S-SARA] State Appeal Policies

As I shared at the RSC meeting yesterday, regarding our proposed amendment to add appeals process to our SARA regulation 13 KAR 4:010:

·         Here is link showing it was on agenda Oct 8 for our Council's Executive Committee Meeting http://cpe.ky.gov/aboutus/agendas/exec_committee/agenda-100819.pdf

·         Next step is it will be on agenda for our Council Meeting Oct 30-31 (the Board book will be posted closer to time here http://cpe.ky.gov/aboutus/cpemeetings.html )

o   If at that meeting the Council votes for us to move forward with filing the proposed amended regulation with the Kentucky Legislative Research Commission (LRC)'s Administrative Regulation Review Subcommittee (ARRS) by November 15,

§  then once LRC updates its webpage, I will share link with this group re: the proposed amended regulation, with cite to the appeals section specifically.

·         At that point, it goes through at least 4 month process before it could be effective.

o   and chart showing the earliest possible effective date would be April 2020 https://apps.legislature.ky.gov/law/kar/karpgs/EffectiveDates.pdf .

o   So, I can also let you all know once that process is complete.

Good morning, SREB-SARA colleagues.

It was so nice seeing everyone again this week!  I hope you all had safe travels home.  Since one of our frequently-discussed topics seems to be the requirement for all SPEs to have an appeals procedure, I thought I would share Oklahoma's (attached PDF).  I hope other states will reply to share their own policy/procedure for appeals so we can all get a better idea of how this looks across states.
