We engaged the National Center for Higher Education Management Systems (NCHEMS) to conduct a survey of institutions that participate in NC-SARA to gather information relevant to estimating those savings; specifically the distance programs offered. NCHEMS is a widely respected national non-profit organization with a long history of research and analysis in higher education. Survey responses will go directly to NCHEMS, and they will only report aggregate information to NC-SARA, therefore keeping the identities of responding institutions confidential. This survey is intentionally brief (less than 5 questions) and should take no more than 5 minutes to complete, yet is designed to provide NC-SARA with valuable information as we explore ways to expand access to students across the nation. A random sample of NC-SARA-participating institutions has been selected to receive the survey. The contact for those institutions will receive a link to the survey instrument, which will arrive in their inbox the week of June 8. The survey will remain open through June 26, 2020. Student homelessness and food insecurity was already a growing crisis before coronavirus, but the pandemic is making the situation even worse. The #RealCollege survey is the nation's largest annual assessment of access to affordable food and housing among college students. Results can be broken down by state and institution, which state systems and individual colleges can use to better understand the degree of housing and food insecurity among their own students, which can help in designing appropriate supports for their students need. The 2018 national report included 86,000 students from 123 two- and four-year institutions across the United States. Results found that: * 45% of respondents were food insecure in the prior 30 days * 56% of respondents were housing insecure in the previous year * 17% of respondents were homeless in the previous year. Recommendations included the following: * Appoint a Director of Student Wellness and Basic Needs. * Engage community organizations and the private sector in proactive support. * Develop and expand an emergency aid program. There is a small fee to participate in the survey, but the Hope Center is a nonprofit organization, so funds are only used to recoup costs. If a college or university cannot afford to pay for the survey, there is a scholarship option that is available to them. State systems and consortia of institutions within a state can receive a bulk discount by working together. The Secretary gave institutions discretion to decide about early implementation of the 2019 state authorization regulations and could be implemented as early as November 1, 2019. However, it is mandatory that institutions comply with the 2019 regulations by July 1, 2020. Following is the list of the revised sections of the 2019 state authorization federal regulations: 1. 34 CFR 600.2 - Definitions - state authorization reciprocity agreement 2. 34 CFR 600.9(c) - State Authorization 3. 34 CFR 668.43 - Institutional Information (includes Professional Licensure Disclosures) 4. 34 CFR 668.50 - Removal of distance education disclosures substituting a severability section As the July 1, 2020 deadline approaches, this update is designed to offer clarity and resources for states and institutions regarding professional licensure disclosures. The regulations covering professional licensure, 34 CFR 668.43 (a) (5) (v) and 34 CFR 668.43 (c), require disclosures by institutions regarding educational requirements for programs leading to professional licensure or certification regardless of modality. So, unlike the previous regulations that focused solely on disclosures for distance education, the 2019 regulations require disclosures for all modalities. Regulation 34 CFR 668.43 (a) (5) (v) covers requirements on general disclosures, while regulation 34 CFR 668.43 (c) covers requirements on direct disclosures. General disclosures inform students of three eligibility categories: * MEETS: states in which the institution's curriculum meets those states' educational requirements for licensure * DOES NOT MEET: states in which the institution's curriculum does not meet those states' educational requirements for licensure * NO DETERMINATION MADE: states in which the institution has made no determination whether the institution's curriculum meets those states' educational requirements for licensure These disclosures must be public for students to find, such as on an institution's website. It is best that institutions collaborate with their in-house counsel to ensure compliance. Direct disclosures inform students of the programs leading to professional licensure or certification that fall into one of the latter two categories above - does not meet or institution has not made a determination. Unlike general disclosures that must simply be made public, direct disclosures must be sent by the institution to the student in writing, and this communication must occur prior to the student's enrollment in the program. Further, if after a student enrolls in a program and the institution later determines the program does not meet educational requirements for professional licensure in the state where the student is located, the institution is required to notify the student in writing within 14 days of making the determination. The data showed that the vast majority of the programs leading to licensure among participating SARA institutions were in five fields: * Counseling * Nursing * Psychology * Social work * Teacher Education There are many educational programs that lead to professional licensure or certification. NC-SARA's resource is general contact information for the five programs only, with no regulations or requirements, and it will be updated biannually. You may ask why this time is different...this time, the regulations were not written by the Department, but rather the regulations were written by key stakeholders who participated in the regulatory process called Negotiated Rulemaking, that came to consensus (100% agreement) in early April 2019. The fact that the regulations came from consensus gives the regulations some additional strength upon future scrutiny. SAN has discussed these regulations in many communications over the last year including in the wcetMix SAN Network Community updates & discussions, Frontiers Posts, webcasts, Open Forum, and more. Today, I will simply offer 5 key components and 5 key resources in preparation for the big day, July 1, 2020. Five Key Components 1. There is no substitute for reading each of the regulations to review the specific language of the regulation. (link to the regulations announced in the Federal Register offered below) 2. 34 CFR 600.2 -state authorization reciprocity agreement * Revised definition. * Does not regulate the entity we know as SARA. 3. 34 CFR 600.9(c) - State Authorization of distance education * Requires state institutional approval through state by state legal compliance where subject to a state's laws and regulations or participation in reciprocity, in order for the institution to participate in Title IV HEA programs. * Determination of student location based upon institution's processes and procedures. * Document the process for determination to share with the Secretary of the Department of Education upon request. (Time of enrollment in the program & upon formal receipt of information from the student from the institutions processes and procedures.) 4. 34 CFR 668.43(a)(5)(v) - General notifications for programs leading to professional licensure or certification * New notification added to the list of notifications required under 34 CFR 668.43 Institutional Information in order to participate in Title IV HEA programs. * Describes the scenario for required notifications for programs leading to professional licensure or certification regardless of modality. * Describes how to provide general notifications for professional licensure programs. (curriculum meets state requirements, curriculum does not meet state requirements, institution has made no determination) 5. 34 CFR 668.43(c) - Direct notifications for programs leading to professional licensure * New notification added to the list of notifications required under 34 CFR 668.43 Institutional Information, in order to participate in Title IV HEA programs. * To prospective students if the curriculum does not meet state requirements or the institution has made no determination where the prospective student is located prior to enrollment in the program. (Prior to enrollment = Prior to financial commitment) * To enrolled student within 14 calendars days of the institution making a determination that the curriculum does not meet state requirements where the student is located. 2016 version of 34 CFR 668.50 - Notifications for Distance Education Programs * The section is removed as most of these notifications were already required in other parts of the Code of Federal Regulations as well as some notifications added to the new Federal regulations. * Acknowledgement of receipt of notifications no longer required, but we have shared that it would be a best practice to protect the institution.
