Thank you for this question. This is a real concern and we look forward to the conversation among the colleagues. In the meantime, I also reached out to Cherly Dowd from WCET/SAN for their perspective. Following is what she provided:

Hello Elisa,

I hope you are doing well!  All fine here in Ohio!

The quick answer is that public institutions and non-profit private institutions are not subject to oversight in California for distance education students located in California. For profit institutions will want to contact BPPE to determine if they are offering flexibilities due to the pandemic.  If the program leads to professional licensure, the institution will want to communicate with the state licensing board to determine if there is additional oversight or perhaps a flexibility due to the pandemic.

Hello,

I hope everyone is doing well during this hectic time. I was hoping to get some feedback regarding how you all are handling non-SARA participating institutions (mostly in California, but some others) that had on-ground students that returned to their home states to complete their programs online - specifically due to COVID-19 closures. Are there any plans or discussions regarding flexibility for non-SARA participating institutions that do not resume in-person classes in the fall and will instead offer online coursework to those out-of-state students who were originally enrolled to attend on-ground?
