Legislative Report

Appropriations

Senate Bill 860 (Senator Kim David and Representative Leslie Osborn) This is an general appropriation measure which includes $773.6 million for the Oklahoma State Regents for Higher Education.

Update: This bill passed the Senate floor on May 24, 2017 by a vote of 33-19 and the House floor on May 26, 2017 by a vote of 57-42.  The bill will be sent to the Governor for signature.

House Bill 2400 (Senator Kim David and Representative Leslie Osborn) This is an general appropriation measure which includes funds for the Oklahoma State Regents for Higher Education.

Update: This bill passed the House Joint Committee on Appropriations on May 23, 2017.

Administration

Senate Bill 26 (Senator Mark Allen and Representative Steve Vaughan) This measure redefines bus as any motor vehicle that is designed for carrying more than 8 passengers.

Update: This bill was signed by the Governor on April 26, 2017.

Senate Bill 326 (Senator Jason Smalley and Representative John Pfeiffer) This measure creates limits to the use of certain contracting programs for roofing repairs on behalf of a state agency.

Update: This bill was sent to the Governor for signature on May 25, 2017.

Senate Bill 430 (Senator James Leewright and Representative John Montgomery) This measure creates the Oklahoma Public Facilities and Infrastructure Act which requires certain processes for government entities to contract with private entities.

Update: This bill was signed by the Governor on May 12, 2017.

Senate Bill 637 (Senator Nathan Dahm and Representative Jason Murphey) This measure creates the Governor’s Transparency Act of 2017, which requires agencies entering into a memorandum of agreement/understanding to publish the agreement on the agency’s website.

Update: This bill was vetoed by the Governor on May 2, 2017.

Senate Bill 697 (Senator Nathan Dahm and Representative Jason Murphey) This measure provided all rulemaking authority delegated by the Legislature used only to implement policy or law set or passed by the Legislature.

Update: This bill was sent to the Governor for signature on May 11, 2017.

House Bill 1384 (Representative Carol Bush and Senator Dave Rader) This measure requires state agencies to provide counseling to employees who are involved in a traumatic event in the workplace.

Update: This bill passed the Senate floor on April 19, 2017 by a vote of 42-0.

House Bill 1574 (Representative Tim Downing and Senator Nathan Dahm) This measure requires state agencies to go through the Attorney General for approval before contracting with private legal counsel.

Update: This bill passed the Senate floor on April 25, 2017 by a vote of 40-3. The Senate named Pittman, Dahm, Sparks, Standridge, Sykes, Newhouse, and Daniels as conferees.

House Bill 1621 (Representative Michael Rogers and Senator Gary Stanislawski) This measure provides that benefits of education service contractors shall be payable in the same amount, terms and conditions of other services.

Update: This bill was signed by the Governor on April 24, 2017.

House Bill 1944 (Representative John Paul Jordan and Senator Nathan Dahm) This measure modifies the APA. Final rules would be approved by the Legislature and Governor.

Update: This bill passed the Senate floor on March 21, 2017 by a vote of 36-6.  The Senate has named Floyd, Boggs, Dahm, Shaw, Fry, Pittman and Kidd as conferees.

House Bill 1996 (Representative John Paul Jordan and Senator Chris Kidd) This measure reauthorizes the Oklahoma Partnership for School Readiness Board until 2023.

Update: This bill was signed by the Governor on May 17, 2017.

House Bill 1999 (Representative John Paul Jordan and Senator Nathan Dahm) This measure creates a joint review committee to review all agency rules.

Update: This bill passed the House floor by a vote of 86-7 on May 10, 2017. The Senate named Floyd, Boggs, Dahm, Shaw Fry, Pittman, and Kidd as conferees.

House Bill 2034 (Representative Charles McCall and Senator Dan Newberry) This measure creates the Oklahoma State Pension Commission.  This bill includes TRS.

Update: This bill was signed by the Governor on May 2, 2017.

House Bill 2316 (Representative Charles McCall and Senator Mike Schulz) This measure changes power of the Governor appointment.
Update: This bill passed the House floor on May 24, 2017 by a vote of 67-26.

House Bill 2424 (Representative Leslie Osborn and Senator Kim David) This is changes the amount the Tax Commission shall pay to the State Treasurer to credit the Multiple Injury Trust Fund for  Workers Comp.

Update: This bill passed the House Joint Committee on Appropriations and Budget on May 15, 2017.

Audit

House Bill 2311 (Representative Charles McCall and Senator Mike Schulz) This measure creates the Agency Spending Review Act which conducts audits of spending of government agencies.

Update: This bill was sent to the Governor for signature on May 18, 2017.

Campus Safety/Weapons
Senate Bill 6 (Senator Josh Brecheen and Representative Jeff Coody) This allows state or federally elected or appointed officials to carry a firearm.
Update: This bill passed the House floor on April 27, 2017 by a vote of 73-11. The House named the Conference Committee on General Government Oversight & Accountability as conferees.  The Senate named Floyd, Matthews, Brecheen, Shaw, Thompson, Fry and Pugh as conferees.

Senate Bill 12 (Senator Josh Brecheen and Representative John Bennett) This measure adds private schools to the Oklahoma Campus Security Act.
Update: This measure was signed by the Governor on April 24, 2017.

Senate Bill 35 (Senator Kim David and Representative Kevin McDugle) This measure allows for concealed or unconcealed carry of legal firearms for persons 21 or older with a handgun license or valid military id during bow hunting or fishing.

Update: This bill was sent to the Governor for signature on May 11, 2017.

Senate Bill 36 (Senator Michael Bergstrom and Representative Bobby Cleveland) This measure updates the definition of pistols and handguns.

Update: This bill was signed by the Governor on April 10, 2017.

House Bill 1428 (Representative Kyle Hilbert and Senator Jason Smalley) This measure creates the Handgun Carry Military Age Exemption Act which allows 18-21 that are members or veterans of the armed forces to be eligible for a handgun license.

Update: This bill was signed by the Governor on April 6, 2017.

Colleges/Universities

Senate Bill 425 (Senator John Sparks and Representative Chris Kannady) This measure allows institutions to sue third parties who participate in an act that violates their rules and causes the institution to lose money.

Senate Bill 816 (Senator Kim David and Representative Leslie Osborn) This measure directs medical schools to give priority consideration of assigning clinical rotations to in-state students.

Common Education/Teacher
Senate Bill 2 (Senator J.J. Dossett and Representative Katie Henke) This measure removes the U.S. History assessment from statewide student assessments.
Update: This bill was vetoed by the Governor on May 3, 2017.

Senate Bill 15 (Senator Stephanie Bice and Representative Ryan Martinez) This measure directs the SDE and OSRHE to develop and implement programs to recruit teachers, subject to the availability of funds, and designates funds generated from the Oklahoma License to Educate license plate to be put in the Oklahoma Teacher Recruitment Revolving Fund.

Update: This bill was signed by the Governor on May 1, 2017.

Senate Bill 29 (Senator Roger Thompson and Representative Dennis Casey) This measure creates an exception for a teacher national criminal history check if a criminal background check has been done in the last year.

House Bill 1161 (Representative Michael Rogers and Senator Gary Stanislawski) This measure modifies the requirements for evaluating teachers and professional development.

Update: This bill passed the Senate floor on April 25, 2017 by a vote of 44-0.  The Senate named Brecheen, Sharp, Stanislawski, Matthews, Dossett, Bergstrom, and Pemberton as conferees.

House Bill 1694 (Representative Scott Martin and Senator Gary Stanislawski) This measure modifies the instruction of financial literacy to include FAFSA and creates the Personal Financial Literacy Revolving Fund.

House Bill 1790 (Representative Ed Cannaday and Senator Dewayne Pemberton) This measure permits school districts to offer remediation based on ACT score.

Update: This bill was signed by the Governor on April 24, 2017.

House Bill 1957 (Representative Rhonda Baker and Senator Ron Sharp) This measure removes the work experience requirement of two years to acquire an alternative placement teaching certificate.

Update: This bill was signed by the Governor on April 24, 2017.

House Bill 2008 (Representative Charles McCall and Senator Gary Stanislawski) This measure creates the Dyslexia and Education Task Force.

Update: This bill was signed by the Governor on May 15, 2017.

House Bill 2349 (Representative Leslie Osborn and Senator Kim David) This measure provides raises for teachers including CareerTech.

Update: The bill passed both the Senate Joint Committee on Appropriations and Budget and House Joint Committee on Appropriations and Budget on May 16, 2017.

House Bill 2386 (Representative Leslie Osborn and Senator Kim David) This measure clarifies the definition of superintendent, principal, supervisor, and school nurse.

Update: This bill passed the House floor on May 24, 2017 by a vote of 74-19.

House Bill 2416 (Representative Leslie Osborn and Senator Kim David) This measure provides $1000 raises for teachers including CareerTech.

Update: The bill passed the House Joint Committee on Appropriations and Budget on May 17, 2017.

House Bill 2417 (Representative Leslie Osborn and Senator Kim David) This measure provides creates a new minimum salary schedule for teachers and shall apply to all careerTech teachers.

Update: The bill passed the House Joint Committee on Appropriations and Budget on May 17, 2017.

Government Consolidation

Senate Bill 868 (Senator Kim David and Representative Leslie Osborn) This measure requires OMES to use certain electronic systems to process payroll by various agencies.

Update: This measure was filed on May 9, 2017 and was assigned to the Senate Joint Committee on Appropriations and Budget.

House Bill 1583 (Representative Chad Caldwell and Senator Kyle Loveless) This measure moves the State Bonds payroll and other services to the State Treasurer.

Update: This bill passed the Senate floor on May 23, 2017 by a vote of 43-0.

Oklahoma’s Promise

Senate Bill 529 (Senator Jason Smalley and Representative Katie Henke) This measure raises the income requirement from $50,000 to $55,000 in 2017-18 school year and $60,000 in 2019-2020 school year and provides other modifications to Oklahoma’s Promise.

Open Records/Meeting

Senate Bill 191 (Senator Roger Thompson and Representative David Brumbaugh) This measure states that a delay in providing open records request is limited only to the time required to prepare the requested information.

Update: This bill was signed by the Governor on May 3, 2017.

Senate Bill 245 (Senator Nathan Dahm and Representative John Paul Jordan) This measure modifies the Oklahoma Open Meeting Act requirements for virtual charter school meetings.

Update: This bill was vetoed by the Governor on May 1, 2017.

Senate Bill 403 (Senator David Holt and Representative Elise Hall) This measure establishes methods for notice of public meetings on websites.

Update: This bill was signed by the Governor on April 25, 2017.

Senate Bill 600 (Senator Jason Smalley and Representative Katie Henke) This measure changes the name of Hillsdale Free Will Baptist College to Randall University.

Regents

Senate Bill 428 (Senator Jason Smalley and Representative Katie Henke) This measure allows teachers who are retired to be reemployed with no limits on earnings.

Senate Bill 690 (Senator Kim David and Representative Lewis Moore) This measure instructs the State Regents, Oklahoma Military Department and schools of social work to develop a Guard Advocacy Program for Oklahoma National Guard soldiers and airmen.

House Bill 1576 (Representative Chad Caldwell and Senator Gary Stanislawski) This measure requires the Oklahoma Commission for Teacher Preparation to include digital teaching.

Update: This bill was signed by the Governor on April 6, 2017.

House Bill 1789 (Representative Ed Cannaday and Dewayne Pemberton) This measure requires the SDE, Commission for Educational Quality and Accountability and State Regents to ensure training on dyslexia.

Update: This bill was signed by the Governor on April 24, 2017.

House Bill 2155 (Representative Jadine Nollan and Senator Gary Stanislawski) This measure requires the SDE to adopt a new statewide system of college and career planning tools called Individual Career Academic Plan.  This measure directs the SDE, State Regents and CareerTech to work together to develop career planning tools for students in 6th through 12th grade.

House Bill 2404 (Senator Kim David and Representative Leslie Osborn) This measure removes the State Regents and institutions which are in the State System from the list of entities which are exempt from sales tax.

Update: This bill passed the House Joint Committee on Appropriations on May 15, 2017.

House Resolution 1020 (Representative Scott Biggs) This resolution recognizes the leadership of State Regent Jimmy Harrel.

Update: The resolution was presented on May 18, 2017.

Retirement/Benefits

Senate Bill 423 (Senator Marty Quinn and Representative Randy McDaniel) This measure reduces the time period an employee has to choose a retirement plan from 90 to 30 days.

Update: This bill was signed by the Governor on May 16, 2017.

Senate Bill 799 (Senator Anthony Sykes and Representative Chris Kannady) This measure allows state employees to use leave for wellness issues.

Update: This bill passed the Senate floor on May 25, 2017 by a vote of 25-18.  The bill passed the House floor on May 26, 2017 by a vote of 66-15.

House Bill 1162 (Representative Randy McDaniel and Senator Gary Stanislawski) This measure sets a minimum age of 67 or 62 after meeting the rule of 90 for employees who become participants in TRS after November 1, 2017.

House Bill 1868 (Representative Jason Dunnington and Senator Roger Thompson) This measure provides overtime for state employees earning less than $40,000 per year.

Update: This bill passed the House floor on May 25, 2017 by a vote of 69-23.

House Bill 2237 (Representative Glen Mulready and Senator Greg Treat) This measure amends the health insurance provision for state employees.

Update: This bill passed the Senate floor on April 27, 2017 by a vote of 40-0. The Senate named Allen, Brown, Treat, Floyd, Dossett, Leewright, Dugger, and Smalley as conferees.

House Bill 2406 (Representative Leslie Osborn and Senator Kim David) This measure creates the Oklahoma Insurance Stabilization Act.

Student Loans

Senate Bill 357 (Senator David Holt and Representative Harold Wright) This measure directs licensing boards to take into consideration student loan default when making licensing suspension decisions.

Senate Bill 170 (Senator Roger Thompson and Representative Earl Sears) This measure redefines rate reduction and establishes new rules for estimating growth.

Senate Bill 293 (Senator Kim David and Representative Leslie Osborn) This measure removes population requirements for tax incentive districts relating to the ad valorem tax.

Senate Bill 731 (Senator Bryce Marlatt and Representative Kevin Calvey) This measure changes interest on proceeds from the sale of oil and gas.

Update: This bill passed the House floor on April 17, 2017 by a vote of 60-23.

Senate Bill 845 (Representative Leslie Osborn and Senator Kim David) This measure creates a cigarette fee of $1.50 per pack.

Update: The bill passed the Senate floor on May 25, 2017 by a vote of 28-18 and passed the House floor on May 26, 2017 by a vote of 51-43.  The emergency clause on the bill failed.  The bill will be sent to the Governor for signature.

House Bill 1423 (Representative Mark Lepak and Senator Jack Fry) This measure reauthorizes the Folds of Honor Scholarship Program tax donation.

House Bill 1856 (Representative Leslie Osborn and Senator Stephanie Bice) This measure creates a task force to study the Tax Code.

House Bill 2347 (Representative Leslie Osborn and Senator Kim David) This measure limits the amount of itemized deductions to $17,000 for tax years 2017-2019.

Update: This bill passed both the House and Senate Joint Committees on Appropriations and Budget on May 11, 2017 and May 12, 2017, respectively.

House Bill 2351 (Representative Leslie Osborn and Senator Kim David) This measure authorizes specific facilities to delay the start of ad valorem exemption period.

Update: The bill signed by the Governor on May 25, 2017..

House Bill 2381 (Representative Leslie Osborn and Senator Kim David) This measure raises the cigarette tax.

Update: The bill passed the House floor on May 15, 2017 by a vote of 76-17.

House Bill 2382 (Representative Leslie Osborn and Senator Kim David) This measure raises the cigarette tax.

Update: The bill passed the House Joint Committee on Appropriations and Budget on May 17, 2017.

House Bill 2403 (Representative Leslie Osborn and Senator Kim David) This measure limits the amount of itemized deductions to $17,000 for tax years 2017-2019.  The $17,000 limit excludes charitable contributions.

Update: This bill passed both the House floor on May 22, 2017 by a vote of 56-40.

House Bill 2405 (Representative Leslie Osborn and Senator Kim David) This measure directs no agency, department, board, and commission to spend any funds on nonessential items such as magnets, buttons, stickers, stationery and etc.

Update: This bill failed in the House Joint Committee on Appropriations on May 22, 2017.

House Bill 2409 (Representative Leslie Osborn and Senator Kim David) This measure levies a 4.5% excise tax on gross receipts of Oil and Gas.

Update: The bill passed the House Joint Committee on Appropriations and Budget on May 15, 2017.

House Bill 2412 (Representative Leslie Osborn and Senator Kim David) This measure sunsets the historic building tax credit on January 1, 2021 and caps the annual amount at $10 million.

Update: The bill passed the House Joint Committee on Appropriations and Budget on May 16, 2017.

House Bill 2413 (Representative Leslie Osborn and Senator Kim David) This measure sunsets the Oklahoma Affordable Housing Tax Credit on December 31, 2020 and caps the annual amount at $2 million.

Update: The bill passed the House Joint Committee on Appropriations and Budget on May 16, 2017.

House Bill 2414 (Representative Leslie Osborn and Senator Kim David) This measure creates a new cigarette tax of 75 cents per pack, taxes gas at 6 cents per gallon, and reduces the amount of time that oil and gas production is taxed a t the 2% rate.

Update: The bill passed the House floor on May 16, 2017 by a vote of 51-46.

House Bill 2415 (Representative Leslie Osborn and Senator Kim David) This measure moves the sunset date for the gross production tax to July 1, 2017. It creates a rebate program for certain wells and projects. Additionally, this measure excludes wind energy from sales tax exemption.

Update: The bill was laid over in the House Joint Committee on Appropriations and Budget on May 16, 2017.

Telecommunications/OneNet

Senate Bill 105 (Senator Roger Thompson and Representative Leslie Osborn) This measure requires the State CIO approve the purchase of any IT products or contracts over $25,000 instead of all purchases.

Update: This bill passed the Senate floor on May 25, 2017 by a vote of 42-0. The House passed the bill on May 26, 2017 by a vote of 88-4.  The bill will be sent to the Governor for signature.

Telemedicine

Senate Bill 726 (Senator AJ Griffin and Representative Glen Mulready) This measure provides standards for the practice of telemedicine.

Update: This bill was signed by the Governor on May 10, 2017.
