Update From the State Capitol

The Legislature continued to work remotely this week on the budget for the upcoming fiscal year.

With a few members of the Legislature and their staff testing positive for COVID-19 and the state Capitol remaining closed to the public, the House and Senate have no plans at this time to meet at the state Capitol next week. However, their business will continue remotely.

In addition to legislative activity, the State Board of Education voted on Wednesday to move all public school students to digital learning platforms beginning April 6 through the end of the school year. All public school buildings will remain closed to students for the remainder of the school year.

On Tuesday, Gov. Kevin Stitt amended Executive Order 2020-07 for the fourth time to list out essential and nonessential businesses. Key to this executive order is provisions that require certain businesses to remain closed from March 26, 2020 to April 16, 2020. OESC Waives Tax Increase
As employers are faced with the possibility of furloughs, layoffs and reducing employees’ hours due to the COVID-19 pandemic, one thing they shouldn’t have to worry about is their unemployment tax rate increasing as a result of increased unemployment claims.

The State Chamber has worked closely with the Oklahoma Employment Security Commission (OESC) and Executive Director Robin Roberson. She has issued an order to waive this tax increase on employers through the end of the year. This will ensure our state can still support employees in need of unemployment benefits while providing for recovery of the unemployment insurance fund and Oklahoma’s economy. Additionally, OESC has also waived the work search requirement for claimants during the COVID-19 pandemic.

Many employers, out of concern for their employees, have decided to move forward with layoffs so employees could qualify for unemployment benefits. But, a reduction in hours (to less than 32 per week) will allow an employee to qualify for benefits. This allows employers to keep valued employees on staff and provide them with the assistance they need during these uncertain times. Unemployment insurance was created to respond to situations like the economic disruption created by the COVID-19 pandemic.

SBA Loans Now Available
Small business owners in all U.S. states, Washington D.C. and territories are currently eligible to apply for a long-term, low-interest loan due to COVID-19.

The U.S. Small Business Administration’s Economic Injury Disaster Loan program provides small businesses with working capital loans of up to $2 million that can provide vital economic support to small businesses to help overcome the temporary loss of revenue they are experiencing. Disaster loans can be used to cover many business expenses, like payroll, accounts payable, equipment and machinery purchases, real estate payments and other bills you cannot pay because of COVID-19.

Update from Washington, D.C.

The U.S. House of Representatives and the U.S. Senate passed the CARES Act, the legislation known as "Phase III" of Congress' COVID-19 recovery package. The CARES Act will provide nearly $2 trillion in aid for American workers and employers. The legislation now moves to President Trump for his signature.

Provisions of the bill include:

·     Relief to small businesses through the "Paycheck Protection Program," an SBA 7(a) loan program primarily intended for payroll for workers

·     Expansion of unemployment benefits to the self-employed, independent contractors, gig workers and others

·     Making small changes to the paid sick leave program implemented under the "Phase II" legislation, including capping the maximum amount of payments and clarifying that workers who are re-hired are eligible for paid leave

·     Direct financial assistance through "recovery checks" to American households

·     More support for hospitals and front-line health care workers to address supply shortages, speed vaccine development and encourage telehealth

Also, the U.S. Department of Labor’s Wage and Hour Division (WHD) announced its first round of guidance on how the Families First Coronavirus Response Act (FFCRA), also known as “Phase II” of Congress' COVID-19 recovery package, will impact employers and employees. FFCRA will take effect on April 1, 2020.
