[Oacrao-l] In-State/Out-of-State Status of Enrolled Students policy

Colleagues,

At their April 20, 2017 meeting, the State Regents approved revisions to the In-State/Out-of-State Status of Enrolled Students policy. These revisions align with public law 114-315, which modified section 3679(c) of Title 38 of United States. These revisions take effect July 1, 2017.

Under the existing version of the policy, an individual who 1) files with the institution within the State System at which the student intends to register a letter of intent to establish residence in the state, 2) resides in state while enrolled in the institution, regardless of the residency of the student or home of record, 3) is entitled to educational or training assistance under section 3311(b)(9) of Title 38 of United States Code, and 4) enrolls within a five year period of the service member's death in the line of duty after the service member served at least 90 days is eligible for in-state status.

By virtue of the amendments that take effect on July 1, 2017, an individual is no longer required to enroll within five years of the service member's death, and there is no longer a requirement that the deceased service member's death in the line of duty followed a period of active duty service of 90 days or more.  This is addressed in policy section 3.17.7.B.3.

Additionally, a new category of eligible individuals was added to the policy.  Under the new category, a person who: 1) files with the institution within the State System at which he/she intends to register a letter of intent to establish residence in the state, 2) is entitled to educational or training assistance under Section 3319 of Title 38 of the United States Code by virtue of a relationship to a person who is currently serving on active duty, and 3) resides in the state while enrolled in the institution, regardless of the student's formal state of residence state or the active service member's home of record, is eligible for in-state status. This is addressed in policy section 3.17.7.A.3.
