[Oacrao-l] In-State/Out-of-State Status of Enrolled Students Policy Revisions

OACRAO Colleagues,

At their January 24, 2019 meeting, the State Regents approved revisions to the In-State/Out-of-State Status of Enrolled Students policy. These revisions align with public law 115-251, which amended section 3679(c) of Title 38 of the United States Code.

Based on the old version of 3679(c), a student who files with the institution within the State System at which the student intends to register a letter of intent to establish residence in the state and who resides in the state while enrolled in the institution shall be eligible for in-state status (i.e., in-state tuition), regardless of the residency of the student or home of record, if the student:

  *   was discharged or released from a period of not fewer than ninety (90) days of active duty uniformed service, less than five (5) years before the date of enrollment in the course(s) concerned; and
  *   is pursuing a course of education with educational assistance under chapter 30 (Montgomery G.I. Bill - Active Duty Program) or chapter 33 (Post-9/11 G.I. Bill) of Title 38 of the United States Code while living in Oklahoma.

The amendments that were made to 3679(c) by virtue of public law 115-251 expand eligibility to include individuals who are using educational assistance under chapter 31 (Vocational Rehabilitation and Employment) of Title 38 of the United States Code.  As such, policy section 3.18.7.B.1 of the In-State/Out-of-State Status of Enrolled Students policy was revised to ensure that chapter 31 recipients who meet the aforementioned criteria are classified as in-state.

These revisions go into effect for courses, semesters, or terms beginning after March 1, 2019.  Therefore, please make sure that you 1) identify chapter 31 recipients who are classified as out-of-state and meet the aforementioned criteria and 2) reclassify them accordingly.
