FYI - attached below is an updated version of the guidance memo on
undocumented immigrant students.  There are no changes in policy, just a

Subject:           Update of January 2 Guidance Memo on undocumented
persons - eligibility for enrollment, resident tuition and financial aid
under HB1804 and SB820

 

 

In my January 2, 2008 Memo to you regarding this subject (copy
attached), I stated that, if necessary, the guidance memo which was
attached to my Memo will be updated.  In response to questions asked by
institutions after the guidance memo was sent out, an updated guidance
memo has been prepared by the OSRHE staff.  That updated guidance memo
is attached.  

 

It is requested that the attached updated guidance memo be sent to those
persons at your institution who will be directly involved in
implementing HB1804, SB820 and the new State Regents policy.  They
should read the memo as soon as possible, and then keep it handy to be
referred to and used as a checklist when analyzing the eligibility of a
particular student.  It is suggested that the original January 2, 2008
version of the guidance memo be discarded and replaced by the updated
version in all relevant files at your institution.  

 

HB1804 and SB820 raise complicated issues.  The OSRHE staff and I
realize that you and your staff may still have questions after the
updated guidance memo is reviewed.  Please contact the appropriate OSRHE
staff person listed on page 7 of the memo regarding any questions.  If
necessary, the memo will be updated again in the future to address those
questions.
