Dear OACRAO member, the Council on Instruction (COI) Academic Affairs Procedures Handbook Committee, chaired by Dr. Clyde Montgomery, met on October 18, 2010 and reviewed committee draft #2. In addition to minor grammatical changes, the committee voted to present the in-state/out-of-state procedures at the full October COI meeting. Following a brief discussion, the full COI posted the in-state/out-of-state procedures at their October 19, 2010 meeting.
Over the next few weeks, please take the time to review the attached in-state/out-of-state procedures and provide feedback or comments. I will call your attention to three new FAQ’s that have been added since the June 15th meeting; 11, 24 and 25. You will notice that number 25 does not have an answer for the question, which is were your expertise comes in. Please provide me with examples of what would be appropriate documentation for individuals, who are self-employed, to supply that are attempting to be classified as in-state under the full-time professional practitioner worker policy.
As you review the procedures, please refer to the revised In-State/Out-of-state Status of Enrolled Students policy if needed (attached). Please try and submit your comments/feedback no later than Friday, November 12th.

I thought the same thing regarding an FAQ for this; great minds think alike. Also, I will be distributing the most recent copy of the in-state/out-of-state procedures via the OACRAO list serve (the COI procedures handbook committee met last week) for final comments, but I’m having some issues with the list serve not sending it out, I keep getting an error message. I contacted Traci Heck, but haven’t received a response.

The students in question are documented foreign nationals on F-2 or J-2 visas at the time of application to OSU (dependents of individuals on F-1 Student or J-1 Exchange Visitor visas). The F-2 students will usually be instructed to change to an F-1 visa within 90 days of the start of their first collegiate semester.

First, for clarification, according to the new In-state/Out-of-state policy, which will become affective systemwide Fall 2011 (Spring 2011 for OSU-Stillwater and OSU-Tulsa), the spouse and/or dependent children of a documented foreign national (with appropriate educational visas) are not eligible for an out-of-state tuition waiver. The spouse and/or the dependent children are eligible for an out-of-state tuition waiver only if the parent or legal guardian is present in the U.S. with visas that allow full-time employment for extraordinary ability in sciences, arts, education, business, athletics, as an executive, manager, or specialist of a treaty nation company as long as they remain in full-time working status.
However, to accommodate students situated within the parameters listed above, OSU may, but is not required, to waive out-of-state tuition (also known as Nonresident Tuition Waiver) in accordance with current State Regents’ Tuition and Fees Policy 4.18.5.B that allows any institution in the State System to waive a portion of the out-of-state tuition which amount shall not exceed the difference between out-of-state tuition and the amount paid by in-state students.
Regarding the student who has graduated from an Oklahoma high school, if s/he has resided with a parent or legal guardian, in Oklahoma, for two years prior to graduation from high school, my interpretation of policy is that s/he would be eligible for an out-of-state tuition waiver.
Now, my question to you is under what conditions will this student be admitted? Is s/he a naturalized citizen, if not, is s/he a lawful permanent resident or a documented foreign national?

We have a question about documented foreign nationals who meet the criteria listed in 3.17.3.E:
Unless residency has been established in another state, an individual who resided in Oklahoma at the time of graduation from an Oklahoma
high school and has resided in the state with a parent or legal guardian for two years prior to graduation from high school will be eligible for in-state status and as allowed in 3.17.6, 3.17.7 and 3.17.8.
It’s my understanding that documented foreign nationals who have not become lawful permanent residents are not eligible for in-state classification, but are eligible for out-of-state tuition waivers – is this correct, or am I interpreting this portion of the new policy too narrowly? If they’re only eligible for a tuition waiver, is this still true even if their documented parent/guardian is in Oklahoma on an educational visa (not a full-time worker)?
